A presidente da Assembleia Legislativa da Bahia (AL-BA), Ivana Bastos (PSD), promulgou a decis\u00e3o do plen\u00e1rio da Casa que, por maioria, reconheceu a legalidade e\u00a0manteve a pris\u00e3o preventiva do deputado estadual Binho Galinha (PRD).\u00a0A medida foi publicada no Di\u00e1rio Oficial do Legislativo neste s\u00e1bado (11), por meio de um Projeto de Resolu\u00e7\u00e3o, seguindo as orienta\u00e7\u00f5es do Regimento Interno.<\/p>\n

A promulga\u00e7\u00e3o ocorre um dia ap\u00f3s o plen\u00e1rio da AL-BA decidir pela manuten\u00e7\u00e3o da pris\u00e3o preventiva de Binho Galinha, preso preventivamente em meio a investiga\u00e7\u00f5es que o apontam como l\u00edder de uma mil\u00edcia em Feira de Santana. A decis\u00e3o foi tomada em sess\u00e3o extraordin\u00e1ria, iniciada \u00e0s 10h, em vota\u00e7\u00e3o secreta e impressa, com 34 votos favor\u00e1veis a manuten\u00e7\u00e3o, 18 contr\u00e1rios e uma absten\u00e7\u00e3o.<\/p>\n

Nas c\u00e9dulas, estavam escritas o seguinte texto: \u201cEm rela\u00e7\u00e3o \u00e0 pris\u00e3o do deputado Kleber Cristian Escolano de Almeida, Binho Galinha, como vossa excel\u00eancia resolve? Revoga a pris\u00e3o ou mant\u00e9m a pris\u00e3o\u201d.<\/p>\n

No dia anterior \u00e0 vota\u00e7\u00e3o,\u00a0o Superior Tribunal de Justi\u00e7a (STJ) manteve Binho Galinha detido, negando o pedido de Habeas Corpus impetrado em seu favor. \u00a0A determina\u00e7\u00e3o foi expedida pelo presidente da Corte, ministro Herman Benjamin. A defesa do deputado buscava reverter a pris\u00e3o, mas o entendimento do STJ foi no sentido de manter a medida.<\/p>\n

Conforme o Regimento Interno, a AL-BA deve comunicar \u00e0 Justi\u00e7a em um prazo de tr\u00eas sess\u00f5es para determinar a perman\u00eancia de deten\u00e7\u00e3o de Binho Galinha. O deputado est\u00e1 preso desde o dia 3 de outubro, ap\u00f3s passar dois dias foragido. Ele foi alvo de uma opera\u00e7\u00e3o da Pol\u00edcia Federal (PF) em sua resid\u00eancia no dia 1\u00ba de outubro, que resultou na pris\u00e3o de sua esposa, Mayana Cerqueira da Silva, e de seu filho Jo\u00e3o Guilherme Cerqueira da Silva Escolano.<\/p>\n
