A presidente do Tribunal Superior Eleitoral (TSE), Ministra C\u00e1rmen L\u00facia, negou seguimento ao recurso extraordin\u00e1rio apresentado pela ex-candidata \u00e0 prefeitura de Porto Seguro, deputada estadual Cl\u00e1udia Oliveira (PSD), contra o prefeito da cidade, J\u00e2nio Natal. Assim, a ministra impediu que o processo que pedia a impugna\u00e7\u00e3o da candidatura do gestor fosse encaminhado para julgamento no Supremo Tribunal Federal (STF).<\/p>\n

No recurso, os opositores afirmaram que J\u00e2nio Natal estaria exercendo um suposto terceiro mandato consecutivo \u00e0 frente do Executivo municipal, o que configuraria viola\u00e7\u00e3o \u00e0 legisla\u00e7\u00e3o eleitoral. A defesa buscava levar a discuss\u00e3o ao STF, sustentando a necessidade de rean\u00e1lise da mat\u00e9ria sob o ponto de vista constitucional.<\/p>\n

Ao analisar o pedido, a ministra entendeu que a quest\u00e3o j\u00e1 havia sido devidamente apreciada pelo pr\u00f3prio TSE. Na decis\u00e3o, destacou que n\u00e3o havia fundamento jur\u00eddico que justificasse o envio do caso ao Supremo, uma vez que n\u00e3o se verificou mat\u00e9ria constitucional nova ou diverg\u00eancia que autorizasse o seguimento do recurso extraordin\u00e1rio.<\/p>\n

Com a negativa, fica mantido o entendimento anteriormente firmado pela Justi\u00e7a Eleitoral, ratificando a perman\u00eancia de J\u00e2nio Natal no comando do governo municipal. A decis\u00e3o refor\u00e7a a estabilidade jur\u00eddica do mandato e encerra, no \u00e2mbito da Justi\u00e7a Eleitoral, mais um cap\u00edtulo da disputa judicial envolvendo o pleito municipal.<\/p>\n

A defesa do prefeito comemorou a decis\u00e3o, afirmando que a tese do terceiro mandato j\u00e1 havia sido afastada pelas inst\u00e2ncias competentes.<\/p>\n
