A a\u00e7\u00e3o foi movida contra Matheus Machado Rocha e Normande Nunes Rocha (PT), candidatos a prefeito e vice-prefeito de S\u00e3o Gabriel, respectivamente. Eles s\u00e3o acusados de abuso de poder pol\u00edtico e econ\u00f4mico e capta\u00e7\u00e3o il\u00edcita de sufr\u00e1gio.<\/p>\n<p>A coliga\u00e7\u00e3o autora da a\u00e7\u00e3o alega que os investigados t\u00eam utilizado a entrega de obras p\u00fablicas e outros bens p\u00fablicos em pleno per\u00edodo eleitoral como uma estrat\u00e9gia para influenciar o eleitorado. A divulga\u00e7\u00e3o dessas a\u00e7\u00f5es por meio de redes sociais tamb\u00e9m foi citada como uma viola\u00e7\u00e3o da legisla\u00e7\u00e3o eleitoral, configurando um uso indevido do poder p\u00fablico em benef\u00edcio da campanha.<\/p>\n<p>Ap\u00f3s revisar os documentos, v\u00eddeos e provas anexadas aos autos, o juiz concluiu que, em uma an\u00e1lise preliminar, havia ind\u00edcios que caracterizavam as pr\u00e1ticas il\u00edcitas denunciadas. O magistrado destacou que a divulga\u00e7\u00e3o de inaugura\u00e7\u00f5es de obras p\u00fablicas durante o per\u00edodo eleitoral compromete a igualdade de condi\u00e7\u00f5es entre os candidatos, um princ\u00edpio fundamental da legisla\u00e7\u00e3o eleitoral.<\/p>\n<p>Matheus Rocha e Normande Rocha est\u00e3o proibidos de realizar qualquer entrega de obras ou outros bens p\u00fablicos durante o per\u00edodo eleitoral, sob pena de multa di\u00e1ria de R$ 10.000,00 para cada ato de descumprimento.<\/p>\n<p>Os investigados t\u00eam 24 horas para excluir de suas redes sociais e das de seus aliados qualquer postagem, foto, v\u00eddeo ou material que promova a entrega de obras p\u00fablicas ocorrida durante o per\u00edodo vedado, sob pena de multa fixa de R$ 5.000,00 para cada postagem n\u00e3o removida.<\/p>\n<p>Os investigados foram intimados a apresentar sua defesa no prazo de cinco dias, em rela\u00e7\u00e3o aos fatos narrados na inicial e \u00e0s medidas liminares deferidas.
